Constitutionalism has gradually taken root in East Asia/Asia. Constitutional review is now being performed in most, if not all, of East Asia/Asia by courts of general jurisdiction or specialized constitutional courts. However, traditional law school approach to the study of constitutional law pays almost little attention to the interaction between constitutional adjudication and politics and to the impact of this interaction on the development of constitutional law in East Asia including Taiwan, Japan, South Korea, Mongolia, China, Hong Kong as well as some Southeast Asian States.
With the publication of Constitutionalism in Asia: cases and Materials (Chang, Thio, Tan and Yeh, Hart 2014), studies on constitutionalism with Asian focus becomes even more feasible. This seminar is aimed at exploring constitutionalism as practice in Asia. The thematic discussion in the seminar will include constituitonal culture, constituional making history, government and seperation of powers, constitutional change, judicial review, equality and equal protection, freespeech, and socio-economic right Students in this seminar are encouraged to have strong participation in the course, as the success of the seminar heavily depends upon the contributions of all participants.
Constitutionalism in Asia: cases and Materials (Chang, Thio, Tan and Yeh, Hart 2014) 的出版,更使得此一研究成為可能。
